CONTROL OF THE NATIONALITY OF INVESTORS FOR INTERNATIONAL ARBITRATORSResumen
La noción de inversionista remite inexorablemente a la noción de nacionalidad. Mientras que el derecho internacional público ha establecido unos criterios claros y de obligatorio ceñimiento para determinar la efectividad de la nacionalidad de las personas, los tribunales arbitrales CIADI han desconocido estos criterios y han preferido adoptar un control demasiado favorable al arbitraje que desconoce los principios generales de derecho internacional y el alcance mismo del Convenio CIADI.
Abstract
The term investor is inexorably linked to the concept of nationality. Although public international law has established clear and mandatory criteria to determine the effectiveness of nationality, ICSI D arbitral tribunals have disregarded such criteria and have rather adopted a pro-arbitration approach inconsistent with the general principles of international law and the very same scope of the ICSID Convention.
