Resumen
La presente investigación tuvo la intención de correlacionar el comportamiento de variables de etnización en el escenario territorial amazónico del Guaviare, -mediante el estudio del caso de la población negra de Calamar-, con los discursos jurídicos sobre la protección especial constitucional destinada a las Comunidades Negras en Colombia y en particular, con las posibilidades de hacer efectivo su derecho fundamental al territorio. El ejercicio investigativo realizado nos permite entender que los discursos contenidos en los diferentes instrumentos jurídicos que regulan la materia, presentan una representación sesgada de las comunidades negras en Colombia, lo cual dificulta la legibilidad de aquellas situadas en la Amazonía Colombiana. A su vez, puede observarse que esta dificultad plantea retos tanto para la institucionalidad como para el Consejo Comunitario Laureano Narciso Moreno, organización que se ha visto debilitada a consecuencia de la espera burocrática que deviene de la ambigüedad que caracteriza la aplicación de la ley 70 del 93 en territorios como el departamento del Guaviare.
Abstract
This investigation was intended to correlate the behavior of ethnicization variables in the Amazonian territorial scenario of the Guaviare, -through the study of the case of the black population of Calamar-, with legal discourses on the special constitutional protection for the Black Communities in Colombia and in particular, with the possibilities of realizing its fundamental right to the territory. The research exercise carried out, allows us to understand that the discourses contained in the different legal instruments that regulate the subject, present a biased representation of the black communities in Colombia, which hinders the readability of those located in the Colombian Amazon. In turn, it can be seen that this difficulty poses challenges both for the institutionality and for the Community Council "Laureano Narciso Moreno", an organization that has been weakened as a result of the bureaucratic wait that comes from the ambiguity that characterizes the application of Law 70 of the 93 in territories such as the department of Guaviare.
