Resumo
A través de su jurisprudencia, la Corte Constitucional ha reconocido la procedencia de la acción de tutela contra laudos arbitrales. Teniendo en cuenta que el trámite arbitral tiene unas particularidades conocidas por las partes al momento de suscribir el pacto arbitral, dentro de las que se destaca que contra el laudo no procede un recurso ordinario por medio del cual se pueda revisar el fondo del asunto resuelto por los árbitros, se considera relevante analizar los casos en los que la Corte ha concedido el amparo constitucional y, así mismo, el alcance de la decisión del juez de tutela.
Con el fin de analizar el tema planteado, se estudiará el arbitraje como mecanismo alternativo de solución de conflictos, la naturaleza del laudo arbitral y los requisitos que se han establecido en la jurisprudencia para que proceda la acción de tutela contra laudos arbitrales, así como los límites que deben observarse en estos casos.
Abstract
Through its jurisprudence, the Constitutional Court has recognized the admissibility of the “acción de tutela” (writ for the protection of constitutional rights) against arbitral awards. Considering that the arbitration process has certain singularities known by the parties at the time of an arbitration agreement signing, one which stands out is that against the arbitral award an ordinary appeal is not applicable mean by which the merits of the case resolved by the arbitrators could be appealed, it is considered relevant to analyze the cases where Constitutional Court has granted constitutional protection and the scope of the decision of the judge.
In order to analyze the issue, this thesis will study arbitration as an alternative dispute resolution mechanism, the nature of the arbitral award and the requirements that have been established in the case law for the "acción de tutela" (writ for the protection of constitutional rights) against arbitral awards, as well as limits that should be observed in these cases.
