Zusammenfassung
La presente investigación la enmarca el Acuerdo General para la Terminación del Conflicto y la Construcción de una Paz Estable y Duradera firmado por el Estado colombiano y las Fuerzas Armadas Revolucionarias de Colombia –Ejército del Pueblo–, de manera especial el punto quinto rubricado como víctimas, en el cual se logró acordar la creación del Sistema Integral de Verdad, Justicia, Reparación y No Repetición.
Sistema que tiene como finalidad contribuir a la lucha contra la impunidad y que por tanto estableció mecanismos judiciales, como la Justicia Especial para la Paz, y extrajudiciales, como la Comisión para el Esclarecimiento de la Verdad, la Convivencia y la No Repetición y la Unidad Especial para la Búsqueda de Personas dadas por desaparecidas en el contexto y en razón del conflicto armado, todos estos con el objeto de investigar y sancionar las graves violaciones a los derechos humanos y las graves infracciones al Derecho Internacional Humanitario, esclarecer la verdad de lo ocurrido, buscar a los seres queridos y reparar el daño causado a las personas y a la sociedad.
Particularmente, el trabajo se centra en un control de convencionalidad doctrinal y difuso que se hace a la normativa (Acuerdo, Actos Legislativos, Ley y Reglamentos) establecida a nivel Colombia para el mecanismo judicial en relación con el estándar que ha fijado la Corte Interamericana de Derechos Humanos en cuanto al derecho, a la justicia y a la reparación que tienen las víctimas directas e indirectas de violaciones y graves violaciones a los derechos humanos y de graves infracciones al Derecho Internacional Humanitario. Lo presente debido a que el sistema internacional de protección de derechos humanos sea de Naciones Unidas por medio de sus comités o el Interamericano a través de la Comisión y Corte, podrán, de forma subsidiaria, proteger y garantizar los derechos humanos de las víctimas del conflicto colombiano cuando el nuevo sistema no sea capaz de hacerlo y, por tanto, quede demostrado que no es una estructura adecuada y/o efectiva para las víctimas. Complementariedad que ha ejercido la Corte Interamericana en diversos casos en relación con Colombia, pero es de destacar que ninguno de ellos en el marco de hechos ocasionados por las Fuerzas Armadas Revolucionarias de Colombia –Ejército del Pueblo–, sino por acciones de las Autodefensas Unidas de Colombia o agentes estatales colombianos.
Dentro del anterior contexto, el objetivo general de la investigación fue determinar si la Justicia Especial para la Paz cumple con los estándares sobre justicia y reparación establecidos por la Corte Interamericana de Derechos Humanos llegando a la conclusión general que el marco normativo que se ha establecido para el funcionamiento de la Justicia Especial para la Paz tiene positivizado, al menos formalmente, el precedente fijado por la Corte Interamericana de Derechos Humanos en casos resueltos contra Colombia y los demás Estados Parte de la Convención Americana sobre Derechos Humanos. Sin embargo, a lo largo del estudio se dejan sentadas y señaladas algunas inquietudes y preocupaciones que podrán darse por una incorrecta interpretación del marco legal colombiano y que podrán generar un no cumplimiento de los estándares y, por ende, una violación adicional a las víctimas.
Abstrakt
The present investigation is framed by the General Agreement for the Termination of Conflict and the Construction of a Stable and Lasting Peace signed by the Colombian State and the Revolutionary Armed Forces of Colombia - Army of the People -, especially the fifth point signed as victims, in which it was agreed to create the Integral System of Truth, Justice, Reparation and Non-Repetition.
System that aims to contribute to the fight against impunity and that therefore established judicial mechanisms, such as the Special Justice for Peace, and extrajudicial mechanisms, such as the Commission for the Clarification of Truth, Coexistence and Non-Repetition and Unity Special for the Search of Persons considered missing in the context and because of the armed conflict, all of them with the purpose of investigating and punishing the serious violations of human rights and the serious violations of International Humanitarian Law, clarifying the truth of what happened , search for loved ones and repair the damage caused to people and society.
Particularly, the work focuses on a control of doctrinal and diffuse conventionality that is done to the regulations (Agreement, Legislative Acts, Law and Regulations) established at the Colombian level for the judicial mechanism in relation to the standard established by the Inter-American Court of Human Rights regarding the right, justice and reparation of direct and indirect victims of violations and serious violations of human rights and serious violations of International Humanitarian Law. Present this because the international human rights protection system is of the United Nations through its committees or the Inter-American through the Commission and Court, may, in a subsidiary manner, protect and guarantee the human rights of the victims of the conflict Colombian when the new system is not able to do it and, therefore, it is demonstrated that it is not an adequate and / or effective structure for the victims. Complementarity that the Inter-American Court has exercised in various cases in relation to Colombia, but it is noteworthy that none of them in the context of events caused by the Revolutionary Armed Forces of Colombia - People's Army - but by actions of the United Self-Defense Forces of Colombia or Colombian state agents.
Within the previous context, the general objective of the investigation was to determine whether the Special Justice for Peace meets the standards on justice and reparation established by the Inter-American Court of Human Rights, reaching the general conclusion that the regulatory framework that has been established to The functioning of the Special Justice for Peace has, at least formally, positiveized the precedent set by the Inter-American Court of Human Rights in cases resolved against Colombia and the other States Parties to the American Convention on Human Rights. However, throughout the study, some concerns and concerns that may arise due to an incorrect interpretation of the Colombian legal framework and that may generate non-compliance with the standards and, therefore, an additional violation of the victims are left sitting and pointed out.
