Zero Tolerance : a migration policy that threatens human securityrésumé
La presente investigación, supone un problema acerca de la crisis migratoria que se vive a diario en la frontera con Estados Unidos. Resulta evidente, que existen muchas inconformidades e irregularidades con la entrada ilegal de migrantes a Estados Unidos y los procesos que se les abren a raíz de esto. Teniendo en cuenta lo anterior, Estados Unidos incurre una grave violación de Derechos Humanos, Civiles y Políticos hacia los migrantes, pues las condiciones en las cuales los detienen y les abren procesos, separando a las familias, resulta ser completamente indignante y un atentado contra la dignidad humana y la libertad.
En relación con las consideraciones anteriores, se puede inferir que la pregunta a resolver en la presente investigación es: ¿Cómo las políticas migratorias del gobierno de Estados Unidos, durante el periodo de la política de “Cero Tolerancia”, afectan la seguridad humana de las familias migrantes que son separadas?
Ahora bien, con el fin de dar respuesta al planteamiento anterior, la hipótesis que esta investigación busca defender es: existe una violación a la seguridad humana tras la implementación de la política de “Cero Tolerancia” debido al atentado a la dignidad humana y a la represión de libertades que se presenta durante el periodo de la política.
En ese orden de ideas, el objetivo general de esta investigación es: Demostrar cómo la política de “Cero Tolerancia”, impuesta por Donald Trump afecta la seguridad humana de las familias migrantes al ser separadas. En ese mismo sentido los objetivos específicos de esta investigación son:
- Especificar cuáles son los derechos vulnerados a las familias migrantes durante el periodo comprendido entre abril y junio del 2018 mediante la implementación de la política de “Cero Tolerancia”.
- Determinar cuáles son las medidas/políticas que se establecieron posterior a la implementación de la política de “Cero Tolerancia”, para la definición de la situación de las familias migrantes que fueron separadas mediante esta política.
- Identificar que tan efectiva y pertinente ha sido la política de “Cero Tolerancia” impuesta por Donald Trump, así como las políticas y medidas posteriores a la implementación de mencionada política
En ese sentido, se hará una revisión bibliográfica de fuentes primarias y secundarias. Por un lado, la fuente primaria utilizada en la presente investigación es la política de Cero Tolerancia. Por el otro, las fuentes secundarias hacen referencia a revisiones e interpretaciones, de diferentes jueces y organizaciones, así como revisiones e informes de prensa acerca de mencionada política. Adicionalmente se utilizará la teoría de la Interdependencia de Robert Keohane y Joseph Nye (1977), así como revisiones acerca de la misma, y la Teoría de Justicia de John Rawls (2006). Lo anterior, con el fin de cumplir los objetivos de la presente investigación.
Abstrait
The present investigation, supposes a problem about the migratory crisis that is lived daily in the border with the United States. It's clear that there are many disagreements and irregularities with the illegal entry of migrants to the United States and the processes that are opened to them as a result. Taking into account the above, the United States incurs a serious violation of Human, Civil and Political Rights towards migrants, since the conditions in which they are detained and open processes, separating families, turns out to be completely outrageous and an attack against the human dignity and freedom.
In relation to the above considerations, it can be inferred that the question to be resolved in the present investigation is: How do the United States government's migration policies, during the period of the “Zero Tolerance” policy, affect the human security of migrant families that are separated?
However, in order to respond to the previous approach, the hypothesis that this research seeks to defend is: there is a violation of human security after the implementation of the “Zero Tolerance” policy due to the attack on human dignity and repression of freedoms that arise during the policy period.
In that order of ideas, the general objective of this research is: To demonstrate how the "Zero Tolerance" policy imposed by Donald Trump affects the human security of migrant families by being separated. In that same sense, the specific objectives of this research are:
- Specify what are the rights violated to migrant families during the period between April and June 2018 through the implementation of the “Zero Tolerance” policy.
- Determine what are the measures / policies that were established after the implementation of the “Zero Tolerance” policy, for the definition of the situation of migrant families that were separated by this policy.
- Identify how effective and relevant the “Zero Tolerance” policy imposed by Donald Trump has been, as well as the policies and measures subsequent to the implementation of the aforementioned policy
In that sense, a bibliographic review of primary and secondary sources will be made. On the one hand, the primary source used in the present investigation is the Zero Tolerance policy. On the other hand, secondary sources refer to revisions and interpretations of different judges and organizations, as well as reviews and press reports about the aforementioned policy. Additionally, the Interdependence theory of Robert Keohane and Joseph Nye (1977) will be used, as well as reviews about it, and the Theory of Justice by John Rawls (2006). The above, in order to meet the objectives of the present investigation.
