La regulación legislativa de las regiones como ente territorial en Colombia mediante la Ley 1962 de 2019 constituye una novedad, luego de más de 28 años de espera para regular la materia. Esta ley es un paso adicional en la posible implementación del modelo regional en Colombia, entendido como un proceso configuración federal que permita articular de mejor manera la descentralización política, fiscal y administrativa, con las demandas reales de la población. El objeto de este estudio es el modelo regional como forma de organización territorial en Colombia, con miras a comprender las dificultades en su implementación. Adicionalmente, con el fin de entender cómo sería la posible implementación del modelo, merece la pena analizar el caso particular de la Región Caribe, que es la que mayores avances ha presentado en el proceso de regionalización. Así las cosas, se busca entender ¿por qué en Colombia no se ha implementado el modelo regional de organización territorial?.
Abstract
The legislative regulation of the regions as a territorial entity in Colombia through Law 1962 of 2019 constitutes a novelty, after more than 28 years of non regulation of the matter. This law is an additional step in the possible implementation of the regional scheme in Colombia, understood as a federal configuration process that allows better political, fiscal and administrative decentralization, searching a real response to the social demands of the population. The object of this study is the regional model as a form of territorial organization in Colombia, seeking to understand the difficulties in its implementation. Additionally, in order to understand what the possible implementation of the model would be like, it is worth analyzing the particular case of the Caribbean Region, which is the one that has made the most progress in the regionalization process. Thus, it is sought to understand why in Colombia the regional model of territorial organization has not been implemented?
