Job contract termination due to retirement pension recognition : analysis of normative and courts decission making and practical appliance of the figureResumen
La terminación del contrato de trabajo con justa causa debido al reconocimiento de la pensión tiene sus inicios en el Decreto Ley 2351 de 1965, como respuesta a las necesidades laborales del momento, y que posteriormente fue adaptada a los cambios introducidos con la creación del Instituto Colombiano de Seguros Sociales (ISS) y con la expedición de la Ley 100 de 1993 por medio de la cual se creó el Sistema General de Pensiones y su modificación mediante la Ley 797 de 2003. Pese al desarrollo normativo, la terminación unilateral del contrato sigue siendo un tema de discusión en las Altas Cortes Colombianas, dado su evolución jurisprudencial e interpretaciones variadas desde la década de los 80´s; lo cual ha desembocado en diversas dificultades prácticas para el uso eficiente de la facultad del empleador. En ese sentido se acude a la investigación socio-jurídica para abordar la problemática y analizar la vigencia de la causal de terminación establecida en el numeral décimo cuarto del literal a) del artículo 7° del Decreto 2351 de 1965, determinar si dicha causal es autónoma e independiente de aquella introducida a la Ley 100 de 1993 mediante el parágrafo 3° del artículo 9° de la Ley 797 de 2003, reconstruir los desarrollos jurisprudenciales de ambas normas e indagar sobre las dificultades actuales que se presentan en el Régimen de Prima Media (RPM) y Régimen de Ahorro Individual (RAIS) a la hora de hacer eficaz la terminación unilateral con justa causa del contrato de trabajo por reconocimiento de la pensión de vejez.
Abstract
The job contract termination with just cause due to the pension recognition has its beginnings in the Law Decree 2351 of 1965, as a response to the labor necessities of the moment, and was subsequently adapted to the changes introduced with the creation of the Colombian Institute of Social Insurances (ISS) and the expedition of the Law 100 of 1993 which created the General Pensions System and its modification through Law 797 of 2003. Despite of the normative development, the unilateral termination of the contract stills being a polemic topic of discussion in the Colombian Courts, considering its jurisprudential evolution and diverse interpretations since the 80’s decade, which has led to diverse practical difficulties for the efficient use of the faculty of the employer. In that way, the social and legal investigation is invoked to tackle the problematic and analyze the validity of the termination cause stablished of the literal a) of Article 7 of the Decree 2351 of 1965, determine if that cause is autonomous and independent from the one introduced to the Law 100 of 1993 through Paragraph 3rd of Article 9 of the Law 797 of 2003, rebuild the jurisprudential developments of both laws and investigate about the actual difficulties that occurs within Average Premium Scheme with Defined Benefit (RPM) and Individual Solidarity Savings Regimen (RAIS) at the time to make effective the unilateral termination of the job contract with just cause due retirement pension recognition.
