Application in Colombia of the principle of free and voluntary collective bargaining in the direct settlement stage : self-regulation or intervention?Resumen
La investigación busca profundizar en la aplicación del Principio de negociación colectiva libre y voluntaria, en el marco de la etapa de arreglo directo en Colombia. En concreto pretende establecer, si el mencionado Principio permite la intervención regulatoria en la negociación colectiva, en particular en la etapa de arreglo directo de Colombia, habida cuenta el alcance promocional o de fomento que la Constitución Nacional y los instrumentos internacionales le dan a la negociación colectiva. De esta forma se realiza un análisis histórico de la negociación colectiva, luego se profundiza en la Doctrina de la Organización Internacional del Trabajo sobre el mencionado Principio, haciendo énfasis en las diferentes limitaciones a la negociación colectiva que la Organización Internacional del Trabajo ha identificado en varias legislaciones. De la identificación de tales limitaciones, se pasa a analizar los aspectos legales y Jurisprudenciales de la etapa de arreglo directo. Por último, se contrasta la revisión hecha en los puntos anteriores sobre el Principio de negociación libre y voluntaria, con la etapa de arreglo directo de Colombia. Este proceso que reúne la descripción y análisis de las problemáticas relacionadas con los límites impuestos legalmente a la negociación colectiva, contribuirá en la reflexión que en el texto se hace, sobre la determinación de términos o plazos de duración de las conversaciones en la etapa de arreglo directo, la imposición de sanciones por no iniciar o dilatar el inicio de las conversaciones dentro de la etapa de arreglo directo en los términos legalmente establecidos, o el señalamiento de materias específicas sobre las cuales las partes pueden o no negociar, aspectos estos que podrían ir en contra de la libertad o autonomía de las partes en la negociación colectiva.
Del análisis y reflexiones realizadas se concluye que, en Colombia existe obligación de negociar, aspecto que, si bien puede reñir con el Principio de negociación libre y voluntaria, se justifica por el carácter constitucional del derecho a la negociación colectiva y su relación con el derecho de asociación sindical. De la misma forma se determina que, la posibilidad de imponer sanciones por no negociar o por no iniciar la negociación en el plazo establecido legalmente, se encuentra sustentada en la Doctrina de la Organización Internacional del Trabajo, no obstante, esta Organización entiende que la eficacia del derecho de negociación colectiva radica en su carácter libre. En virtud de lo anterior, la Organización Internacional del Trabajo, plantea que no deberían existir medios coercitivos, pero sí admite la imposición de sanciones por conductas que afecten el Principio de la negociación de buena fe, o sean consideradas como prácticas desleales dentro del proceso de negociación. Desde esta óptica, como lo ha admitido la Corte Constitucional, la imposición de las sanciones establecidas legalmente en Colombia deben ser analizadas en cada caso particular y siempre que, no exista duda sobre la injustificada negativa a negociar o a iniciar la negociación en el plazo establecido en la Ley . Igualmente se concluye que, las partes del proceso de negociación colectiva son libres a la hora de establecer los beneficios convencionales y a quién aplican. En esta medida, se cierra mencionado el informe preliminar hecho por el Comité de Libertad Sindical de la Organización Internacional del Trabajo frente a los alcances del Acto Legislativo 1 de 2005, el cual deja ver que para este organismo dicha modificación constitucional puede resultar atentatoria del mencionado Principio. Lo anterior pues por la norma constitucional mencionada, como resultado de la negociación colectiva de trabajo no podrán las partes establecer parámetros distintos a los legales en lo que tiene que ver con las reglas de carácter pensional, limitante que, para la Organización Internacional del Trabajo no fue debidamente concertada.
Abstract
This research seeks to deepen the application of the Principle of free and voluntary collective bargaining, within the framework of the direct settlement stage in Colombia. Specifically, it seeks to establish whether the Principle allows regulatory intervention in collective bargaining, particularly in the direct settlement stage of Colombia, considering the promotional or promotion scope that the National Constitution and international instruments give to collective bargaining. In this way, a historical analysis of collective bargaining is carried out, then the doctrine of the International Labor Organization on the Principle, emphasizing the different limitations to collective bargaining that the International Labor Organization has identified in various laws. From the identification of such limitations, we proceed to analyze the legal and jurisprudential aspects of the direct settlement stage. Finally, the review made in the previous points on the principle of free and voluntary negotiation is contrasted with the stage of direct settlement in Colombia. This process that describes and analyzes the problems related to the limits legally imposed on collective bargaining, will contribute to the reflection that is made in the text, on the determination of terms or duration of the conversations in the direct settlement stage, the imposition of sanctions for not initiating or delaying the start of the talks within the direct settlement stage under the legally established terms, or the indication of specific matters on which the parties may or may not negotiate, aspects that could be against the freedom or autonomy of the parties in collective bargaining.
From previous analysis and reflections is concluded that, in Colombia, there is an obligation to negotiate, an aspect that, although it may conflict with the Principle of free and voluntary negotiation, is justified by the constitutional nature of the right to collective bargaining and its relationship with the right of union association. In the same way, it is determined that the possibility of imposing sanctions for not negotiating or for not starting the negotiation within the legally established period is also supported by the Doctrine of the International Labor Organization, however, this Organization understands that the effectiveness of the right to collective bargaining lies in its free character. By virtue of the foregoing, the International Labor Organization states that there should be no coercive means, but it does admit the imposition of sanctions for conducts that affect the Principle of negotiation in good faith or are considered as unfair practices within the negotiation process. From this perspective, as the Constitutional Court has admitted, the imposition of sanctions legally established in Colombia must be analyzed in each case and provided there is no doubt about the unjustified refusal to negotiate or to start the negotiation within the term established in the Law . It is also concluded that the parties to the collective bargaining process are free when it comes to establishing the conventional benefits and to whom they apply. In this measure, the preliminary report made by the Committee on Freedom of Association of the International Labor Organization regarding the scope of Legislative Act 1 of 2005 is mentioned, which shows that for this body the constitutional provision may violate the Principle. The foregoing because, due to the constitutional norm, as a result of the collective bargaining of labor, the parties will not be able to establish parameters other than the legal ones in what has to do with pension rules, a limitation that, for the International Labor Organization it was duly arranged.
