Los Derechos Humanos en la era contemporánea han estado presentes en
el discurso político, social y cultural. De esta manera, los derechos humanos
tienen su reconocimiento mediante numerosos tratados internacionales
tanto a nivel universal como regional y por la creación de órganos
jurisdiccionales y de veeduría para su promoción, defensa y garantía.
Dentro del Sistema Interamericano de Derechos Humanos, se establecen
derechos básicos reconocidos a los migrantes, sin que esto, implique un
derecho a la migración per se. Estos derechos se encuentran en el marco
del principio de no discriminación y la obligación general de respeto de los
derechos humanos reconocidos en los instrumentos internacionales, con lo
cual, si no se cumple con ello, puede acarrear posible responsabilidad del
Estado por acción u omisión.
Abstract
Human Rights in the contemporary era have been present in
political, social and cultural discourse. In this way, human rights
are recognized by numerous international treaties
both at the universal and regional levels and by the creation of bodies
jurisdictional and oversight for its promotion, defense and guarantee.
Within the Inter-American Human Rights System, Results
basic rights recognized for migrants, without this implying a
right to migration per se. These rights are found in the framework
of the principle of non-discrimination and the general obligation to respect
human rights recognized in international instruments, with the
which, if not complied with, may lead to possible liability of the
