Resumo
El objetivo principal de esta tesis es mostrar la situación actual de la protección al consumidor financiero en el ordenamiento jurídico colombiano. Con este fin, se hace un estudio de derecho comparado enfocado en la Declaración Universal de los Derechos de los Usuarios de los Servicios Financieros y Bancarios, las directivas, reglamentos y recomendaciones de la Unión Europea en materia de consumo financiero y la normatividad vigente en México, Perú, Panamá, El Salvador, Chile, Argentina y Venezuela, para terminar con el análisis del sistema de protección al consumidor financiero existente en nuestro país. En Colombia, la protección de los derechos de los consumidores de servicios financieros se encuentra dispersa en el ordenamiento jurídico, por tal razón, fue necesario complementar el análisis legislativo, con la jurisprudencia de la Corte Constitucional y con los conceptos y resoluciones de la Superintendencia Financiera, para poder definir los derechos básicos de los consumidores financieros, los mecanismos de defensa y de participación ciudadana y los efectos del Proyecto-Ley No. 282 de 2008 Cámara y 286 de 2008 Senado (reforma financiera) en la protección de los consumidores financieros. Concluyendo, que hay una regulación amplia en la materia, pero ajena al consumidor.
Abstract
The main goal of this thesis is to show the actual situation of the users rights protection of financial services in Colombian legal regulation. To achieve this goal a comparative law study is done taking as a base The universal declaration of bank and financial service users rights, the directives, rules and recommendations given by the European union on this subject, and the actual regulations about financial consumption in the Latin-American countries, standing out the legislative development of Mexico, Peru, panama, El Salvador, Chile, Argentina and Venezuela, to end with the analysis of our country s financial consumer s protection system. In Colombia, the users rights protection of financial services is disperse in the legal order, for this reason, it was necessary to complement the legislative analysis with the study of the case-law declared by the constitutional court, and with the concepts and resolutions drawn by the financial superintendence, in order to define the basic rights of financial users, its defense and citizens participation mechanisms, and the effects of the actual financial reform (law-project No.282 of 2008 Chamber and 286 of 2008 Senate) about financial users protection. To conclude knowing that there is a large regulation about this subject but unknown by the users.
