El objetivo del presente proyecto de tesis es profundizar el análisis del tema del arbitrio y la arbitrariedad judicial, mediante el estudio de sentencias de la Corte Suprema de Justicia de los años 2002 y 2004. Para tal propósito se hará una descripción teórica respecto al tema así como una referencia a los elementos conceptuales que sobre el mismo han arrojado tanto la Corte Constitucional como la Corte Suprema de Justicia. Se tendrá como hipótesis de trabajo que el arbitrio judicial consiste en el uso adecuado de la argumentación en cada caso concreto, mientras que la arbitrariedad equivale a una inadecuada o inexistente argumentación. El análisis de las sentencias seleccionadas muestra la existencia tanto de arbitrio como de arbitrariedad en las mismas. Las principales conclusiones fueron que la identificación del arbitrio y la arbitrariedad corresponde a un ejercicio interpretativo y argumentativo por parte del operador jurídico en cada caso concreto.
Abstrait
This work s purpose is to deepen the analysis of the subject related with the judicial judgment and judicial arbitrary action, by means of studying a set number of rulings from the Supreme Court of Justice in the year 2002 and 2004. Therefore we will describe the theoretical field of the judicial judgment and judicial arbitrary action, as well as its conceptual elements provided by the Constitutional Court and the Supreme Court of Justice. The hypothesis of this work is that judicial judgment involves the correct use of reasoning for each specific case, on the contrary arbitrary action is equivalent to the incorrect use or lack of reasoning. The analysis of the selected rulings shows the presence of both judicial judgment and judicial arbitrary action. The main conclusions were that to identify judicial judgment and judicial arbitrary action, the legal operator must exercise both interpretation and reasoning activities for each specific case.
