Esta investigación se ha desarrollado en tres capítulos: El primer capítulo hace un recorrido histórico jurídico de la dispensa en la Iglesia que nos muestra la evolución del concepto y la normativa desde su origen hasta la formulación actual en el Código vigente. El segundo capítulo nos habla sobre el estudio de la dispensa, haciéndonos un comparativo de! matrimonio rato y no consumado en los Códigos de derecho Canónico, partiendo del contexto de la dispensa en general, mostrándonos la delimitación de este tema dentro del Código como también el desarrollo de su proceso jurídico, tanto como la autoridad competente En el tercer capítulo se presenta una fundamentación del aspectos pastoral y salvífico de la dispensa matrimonial rato y no consumado, a través de los distintos documentos magisteriales de la Iglesia que hacen referencia al sacramento del matrimonio, la familia, la indisolubilidad y la alianza. La Metodología que se empleó en la elaboración de esta investigación fue basada en la metodología histórica, comparativa, y explorativa, a través y por medio de estas directrices, se ha llegado a una sene de conclusiones, que nos permiten descubrir el papel de la iglesia entre los fieles como un ente Jurídico pastoral de gran mediación y atención de sus miembros, que a lo largo de la historia viene estructurándose y fortaleciendo su ordenación jurídica.
Astratto
This research was developed in three chapters: The first chapter makes a historical overview of the legal dispensation in the Church that shows the evolution of the concept and policy from its origin to the current formulation in the current Code. The second chapter talks about the study of immunity, making a comparative rato and unconsummated in the Codes of Canon Law, based on the context of the waiver in general, showing the delimitation of this issue within the Code as the development of its legal process, as well as the competent authority. In the third chapter a foundation of pastoral and salvific aspects of matrimonial dispensation while and not consummated, through the various magisterial Church documents that refer to the sacrament of marriage, the family, the indissolubility and the alliance is presented. The methodology used In the preparation of this research was based on historical, comparative and explorative methodology, through and through these guidelines, it has reached a number of conclusions that allow us to discover the role of the Church among the faithful as a legal entity of great pastoral mediation and attention of its members, which throughout history has been structuring and strengthening its legal organization.
