dc.description.abstract | La nota explora el aporte de ciertos laudos arbitrales recientes dictados contra Argentina en lo relativo a las reglas y métodos de indemnización aplicables en diversas situaciones de hecho. El autor avanza cuatro conclusiones preliminares: (i) Tres niveles de reglas y/o métodos relativas/os a la determinación de daños deben ser distinguidos (estándares de reparación, estándares de indemnización y métodos de valoración) siguiendo una intensidad normativa decreciente; (ii) La determinación de la aplicabilidad de uno u otro estándar de indemización, cuando no deriva de un tratado internacional, no parece estar basada en el tipo de estándar de comportamiento que ha sido menoscabado, sino en la caracterización del objeto de valoración; (iii) Dicha caracterización debe tomar en cuenta (al menos) tres elementos fundamentales, a saber, las pretensiones de las partes como límite externo, las exigencias del vínculo de causalidad en un caso dado y el tipo de interferencia del Estado; (iv) A la luz de estos criterios parece más apropiado aplicar el estándar “actual loss” para evaluar la pérdida de ingresos futuros específicos y el estándar “fair market value” para evaluar la supresión (total o equiparable) de la capacidad de generación de ingresos. | spa |

dc.description.abstractenglish | The note explores the lessons of a number of recent arbitral awards rendered against Argentina with regard to the rules and methods applicable to determine compensation according to the different factual situations under review. The author reaches four preliminary conclusions: (i) Three levels must be distinguished (standards of reparation, standards of compensation and valuation methods), going from legal rules well-grounded in international investment law to mere valuation methods not required by any specific norm; (ii) Unless otherwise provided in a treaty, the applicability of alternative standards of compensation does not seem to be based on the standard of treatment that has been breached but on the locus of damage; (iii) In order to circumscribe such locus, at least three main elements must be taken into account, namely the specific relief requested by the parties, the requirements of causality and the type of State interference; (iv) In light of these three elements, the “actual loss” standard seems better adapted to claims for specific profits, while the “fair market value” standard appears more suitable for assessing compensation for deprivation of a going concern. | eng |
