The Llegal Advances to the Establishment of a South American Market, and the Perspectives by the Treaty of Unasurrésumé
Este artículo presenta los avances jurídicos contenidos en el Mercosur y en la Comunidad Andina de Naciones, CAN, hacia la creación de un Mercado Común Suramericano, MCS; el derecho del Mercosur y de la CAN y sus jurisdicciones para la garantía del establecimiento del mercado común. En este trabajo, se entiende como MCS a los dos procesos independientes de integración en Suramérica, es decir, el Mercosur y la CAN. Aunque en el marco de dichas organizaciones hay notables avances en la regulación para la construcción de un mercado común, las mismas no son suficientes para que se pueda hablar de su existencia. Asimismo, el artículo se ocupa de las perspectivas para un MSC con la adopción del Tratado de la Unasur. Finalmente, se toma el mercado común europeo como modelo comparativo para la integración suramericana. En este sentido, se aborda el análisis del mercado común,las libertades comunitarias y la relación entre este primer concepto y derecho de la Unión
Abstrait
This paper presents the legal developments contained in the Mercosur and the Andean Community of Nations CAN towards the creation of a South American Common Market SCM; the Mercosur law and Andean law, and the jurisdiction to the guarantee of the establishment of the Common Market. In this paper SCM means the two independent integration processes in South America i.e., Mercosur and CAN. Although within these organizations there are significant advances in the regulation for the construction of a common market, they are not sufficient to be able to speak of the existence of a Common Market. The article deals with the perspectives for an SCM with the adoption of the Treaty of Unasur. Finally, one takes the European Common Market as a comparative model for South American integration. In this sense, the analysis addresses the Common Market, the Common Fundamental Freedoms and the relationship between the Common Market and European Union law.
