Desde la perspectiva histórica y mediante un análisis cualitativo-descriptivo se hace una revisión de las funciones que consagra la ley para el promotor cura- dor de menores, hoy llamado defensor de familia, entrelazando las funciones que a partir de la Ley 83 del 1946 le han sido asignadas. En el paradigma de interpretación teleológico, el derecho moderno tiende a ser integral y universal en la protección de la infancia y en la defensa de la institución de la familia. A partir de la revisión de las funciones se crea un concepto del defensor de familia, el cual no ha sido expresado en la ley; se obtiene una clasificación del defensor de familia y se determina que su accionar como administrador de justicia y como ente conciliador se tiende a confundir. 

From the historical perspective and by means of a qualitative-descriptive analysis a revision becomes of the functions that consecrates the Law for defending the curator-promoter of family minors today called; interlacing the functions that from Law 83 of 1946 him have been assigned. In the teleo- logical paradigm of interpretation, the modern right tends to be integral and universal in the protection of the childhood and the defense of the institution of the family. From the revision of the functions a concept of the family defender is created, who has not been expressed in the Law; a classification of the family defender is obtained and his is determined that to drive as justice administrator and as conciliator being tends to confuse.
