La eficiencia del seguro obligatorio de transporte de carga terrestre en Colombia

Resumen
Mediante el Decreto 01 de 1990, la legislación colombiana facultó al Gobierno Nacional para reglamentar, y por esta vía hacer exigible, un seguro de obligatorio de responsabilidad civil contractual y extracontractual para el transportador de carga terrestre. Sin embargo, casi tres décadas después, la norma no ha sido implementada por el Ejecutivo. Con auxilio de las herramientas del análisis económico del derecho, puntualmente de las nociones desarrolladas por Kaldor y Hicks, este texto se propone examinar la eficiencia de tal imposición, haciendo un recorrido transversal sobre el contrato de transporte, el contrato de seguro y el régimen de responsabilidad del transportador.
Abstract
By means of Decree 01 of 1990, Colombian legislation authorized the National Government to regulate, and thereby make enforceable, compulsory insurance for contractual and extracontractual civil liability for the land freight transporter. However, almost three decades later, the norm has not been implemented by the Executive. With the help of the tools of the economic analysis of law, punctually of the notions developed by Kaldor and Hicks, this text intends to examine the efficiency of such commandment, making a cross-section on the contract of transport, the insurance contract and the regime of Carrier liability.
