Resumen
Se presentan los momentos y etapas en la evolución del concepto de medio ambiente desde una concepción antropocéntrica hacia otra de tipo biocéntrico. Esta evolución se ha reflejado en su noción jurídica donde el derecho y el Estado no solamente deben proteger la dignidad y la libertad del hombre sino también la amenaza que representa la explotación y agotamiento de los recursos naturales. Se reconoce el bien jurídico ambiental en sus diferentes dimensiones como valor constitucional, derecho fundamental, deber, obligación, garantía y principio. Se enfatiza la naturaleza y caracterización de los Principios Constitucionales Ambientales, en contraste con una simple enunciación de ideales. Estos principios incluyen el de Protección del Medio Ambiente, y la Defensa y Conservación de los Recursos Naturales, el de Responsabilidad en la conservación y defensa del ambiente, el de Solidaridad, el de Desarrollo Sostenible, el de Participación, el de Unidad de Gestión o Gestión Integrada por parte de las agencias gubernamentales, el de Progresividad en materia de protección al medio ambiente, el de Unidad y Autonomía en materia ambiental y los de Coordinación, Concurrencia y Subsidiaridad. Como conclusión, el documento señala que resulta deseable con el propósito de salvaguardar el interés colectivo que se apliquen directamente los preceptos constitucionales llamados principios teniendo en cuenta que los desarrollos legislativos han respondido a intereses individuales de los grupos económicos que obtienen beneficios de la explotación de recursos naturales tales como el sector minero energético y las hidroeléctricas.
Abstract
The moments and stages in the evolution of the concept of environment from an
anthropocentric conception to a biocentric one are presented. This evolution has
been reflected in its legal legislation where the law and the State must not only
protect the dignity and freedom of man, but also the threat posed by the
exploitation and depletion of natural resources. The environmental legal good is
recognized in its different dimensions such as constitutional value, fundamental
right, duty, obligation, guarantee and principle. The nature and characterization of
the Constitutional Environmental Principles is emphasized, in contrast to a simple
enunciation of ideals. These principles include the Protection of the Environment,
the Defense and Conservation of Natural Resources, the Responsibility and
Defense of the Environment, Sustainable Development, Participation, the
Management Unit, Comprehensive Management of Government Agencies,
Progress in Protection of the environment, autonomy unit in environmental matters
and coordination, concurrence and subsidiarity. In conclusion, the document states
that the results with the purpose of safeguarding the collective interest that applies
directly to the constitutional precepts, the principles that take into account, the
legislative developments, that respond to the individual interests of the economic
groups that obtain benefits of the exploitation of resources. Natural stories such as
