Resumen
A través del presente documento se desarrollará el análisis jurisprudencial de tres (3) decisiones judiciales que fueron asignadas por la Coordinación de la Especialización de Derecho de Seguros de la Pontificia Universidad Javeriana, con el objeto de profundizar en las temáticas abordadas y las consideraciones expuestas por las respectivas autoridades judiciales para solucionar los casos respectivos.
Para lograr lo anterior, se seguirán los lineamientos impartidos para el desarrollo de este análisis, los cuales se pueden concretar en: identificar las cadenas argumentativas de los fallos, inclusive las de instancia, de cara al problema jurídico que plantea el caso, investigar la posición doctrinaria frente al asunto y definir una posición crítica frente a las mismas.
Abstract
Through this document the jurisprudential analysis of three (3) judicial decisions that were assigned by the Coordination of Specialization Insurance Law of the Pontificia Universidad Javeriana, in order to deepen the themes addressed and the considerations will be developed by the respective judicial authorities to solve the respective cases.
To achieve this, the guidelines given for the development of this analysis, which can be specified in be followed: identify argumentative chains failures, including instance, facing the legal problem raised by the case, investigate the position doctrinaire deal with the issue and define a critical position against them.
