dc.description.abstract | El derecho a la paz es un derecho constitucional de carácter sui generis que ha sido objeto de discusión en la Corte Constitucional en muy pocas oportunidades, sobre todo si se tiene en cuenta que Colombia se encuentra, desde hace más de 70 años, en una situación permanente de conflicto armado interno. Con las negociaciones de paz en La Habana, Cuba, entre el Gobierno Nacional y las FARC-EP, resulta pertinente revisar la actuación de la entidad encargada de la guarda de la integridad y la supremacía de la Constitución frente a este derecho, otorgándole una nueva definición y proponiendo que sea su Sala Plena, en cumplimiento de la función constitucional que le asiste conforme al artículo 241 de la Carta, la que ejerza de manera oficiosa el control constitucional de los acuerdos de paz que se alcancen en la mesa de negociaciones. | spa |

dc.description.abstractenglish | The right to peace is a sui generis constitutional right that has been matter of discussion on few occasions by the Constitutional Court, especially if it’s taken into consideration that Colombia has been, for over 70 years, in a permanent situation of internal armed conflict. With the peace negotiations between the National Government and FARC-EP, it becomes appropriate to review the performance of the state organ in charge of guarding the integrity and supremacy of the Constitution regarding this right, giving it a new definition and proposing that the Constitutional Court Plenary, in fulfillment of the role given by the Article 241, exercises its judicial review duty of the peace agreements reached by the parties in the peace dialogues. | spa |
