Desarrollo del estándar de “Trato justo y equitativo” de los tratados bilaterales de inversión durante la segunda mitad del siglo XX

El creciente interés de los países en vía de desarrollo por atraer inversión extranjera, ha desencadenado la firma indiscriminada de tratados bilaterales de inversión y la inclusión del estándar de “trato justo y equitativo” en los mismos. Este estándar pretende ofrecer seguridad y garantías a los inversionistas extranjeros con respecto a sus inversiones y garantizar un trato justo y equitativo por parte del estado receptor de la inversión. No obstante, ¿a qué se refiere el término justo y equitativo? ¿qué alcance tiene este estándar? Se ha generado alarma alrededor de las implicaciones negativas que pueda tener éste estándar, por lo cual, esta investigación pretende hacer un acercamiento al mismo, partiendo de su recuento histórico y finalizando con un planteamiento del debate que se ha generado en torno a su efectividad.

Abstract

Foreign investments have become the most successful mean to empower a countries development; it is why the juridical scene has become a lot more flexible in hopes of attracting them. Bilateral Investment Treaties have become indeed the path towards achieving this goal, and within these, the “equitable and fair” treatment standard assures the investors the protection of their investments and rights. However, debate has arisen. Will these measures represent a danger in the future to its subscriber’s countries? The “equitable and fair” treatment standard, as practical as it seems, is excessively ambiguous and risky. It is much too vague and much too open for interpretation. The question lies beneath its true possibility to achieve its goal or against all odds, towards the chance it may deviate from its purpose.
