¿Sentencias inejecutables? -La modificación de las fronteras colombianas mediante sentencias-

La demanda de Nicaragua contra Colombia ante la Corte Internacional de Justicia (C.I.J.), por la cual dicho país solicita al tribunal declarar su soberanía sobre el archipiélago de San Andrés y Providencia, lleva a discutir si una sentencia judicial internacional podría modificar los límites territoriales de Colombia, asunto que cobra especial actualidad, por cuanto la sentencia de la Corte del 13 de diciembre de 2007, abre la puerta para la alteración de los límites marítimos colombianos. El presente artículo busca determinar, más allá del caso concreto, si una decisión judicial internacional que modifique las fronteras de Colombia sería ejecutable.

Abstract

The complain filed by Nicaragua against Colombia before the International Court of Justice (I.C.J.), by which the claimant asks the Court to declare its sovereignty over San Andrés and Providencia, has brought into question the possibility of modifying the territorial delimitation of Colombia, by an international judicial decision. The issue acquires special relevance today, as the decision taken by the Court on December 13th 2007, opens possibility for altering the Colombian maritime limits. This article’s purpose is to determine, transcending the particular case, whether or not a decision of the I.C.J. changing the current limits of Colombia would be enforceable.
