Hacia el regionalismo comercial

Este artículo aborda el problema del conflicto de normas entre las de la Organización Mundial del Comercio y las que regulan las integraciones regionales. Para encontrar una solución no basta analizar estas normas desde la teoría de las fuentes del derecho internacional ya que en materia internacional no hay jerarquía de fuentes. Es necesario examinar las disposiciones de los acuerdos de la OMC en concreto, para verificar si en ellas se establece que prevalecerán sobre las normas posteriores. Como ello no ocurre, la solución del problema dependerá entonces del grado de generalidad de sus disposiciones, ya que de ser generales, prevalecerían las normas que regulan las integraciones regionales en virtud del principio de especialidad.

Abstract

This article deals with the conflict of norms between those that govern the World Trade Organization and those that govern regional integrations. In order to solve this issue, it is not enough to analyze these norms by using the theory of the sources in international law due to the lack of hierarchy in the international sphere. It is necessary to examine the dispositions of the WTO agreements in concreto, to verify if it is established that they shall prevail over subsequent norms. Since that is not possible, the solution to the problem will depend on the degree of generality of its dispositions because, if it is found that they are general, the norms that govern regional integrations would prevail, by virtue of the principle of specialty.
