Esta disertación surge de una situación, que consideramos, ha desconfigurado el Régimen de Responsabilidad Extracontractual del Estado y cercenado el alcance de la Acción de Reparación Directa, para aquellos particulares que pretendan exigir mediante esta acción la reparación del daño antijurídico producido por el Legislador al crear normas tributarias declaradas inexequibles, pero cuya efectos se mantienen gracias a la modulación del fallo y es que siendo improcedente por cuanto no hay daño que imputar. Nos hemos propuesto justificar su procedencia a pesar del efecto concedido al fallo, incluso plantear un escenario, que si bien es teórico produciría un daño antijurídico
Abstract
This dissertation arises from a situation that we consider has deconfigured the State's Non-contractual Liability Regime and curtailed the scope of the Direct Remedy Action, for those individuals who intend to demand through this action the reparation of the unlawful damage produced by the Legislator when creating tax rules declared unenforceable, but whose effects are maintained thanks to the modulation of the ruling and that is being inadmissible because there is no harm to be attributed. We have proposed to justify its provenance despite the effect granted to the ruling, including setting out a scenario that, although theoretical, would produce unlawful damage.
