Causation in Tort Law: towards the modification of the theory of the adequate causeResumen
El nexo de causalidad constituye uno de los elementos fundamentales para que pueda atribuirse la responsabilidad a una persona por la conducta desplegada. En Colombia, la Corte Suprema de Justicia ha utilizado distintas teorías de causalidad a través del tiempo, con el objetivo de determinar el vínculo de causalidad entre una conducta y el daño ocasionado. Actualmente, esta Corporación aplica la teoría de la causalidad adecuada, en virtud de la cual se examina si en un contexto de normalidad, teniendo presente las reglas de la experiencia, determinado evento puede ser considerado causa del daño. En el presente escrito se recopilará jurisprudencia de la Corte con el fin de analizar su aplicabilidad en sede judicial e identificar sus dificultades. Realizado lo anterior, se sugerirá reemplazar la teoría de la causa adecuada por un criterio que se ajuste verdaderamente al propósito de la causalidad: el But For Test (también denominado Conditio Sine Qua Non).
Abstract
The causation constitutes one of the key components for the existence of civil liability. In Colombia, the Supreme Court of Justice has used different theories to identify the causality over time, with the aim of determining the linkage between an activity and the damage inflicted. Currently, this Corporation applies the theory of the adequate cause, which studies in a normality context, bearing in mind the rules of experience, the circumstances that may be considered as the causes of the damage suffered by an individual. In this document, the Court's jurisprudence will be compiled in order to analize the applicability of said theory and identify its difficulties. Lastly, it will be suggested to replace the theory of the adequate cause with an approach that properly suits the purpose of the causation in fact: the But For Test (also called Conditio Sine Qua Non).
