Uno de los conceptos más novedosos en el discurso, la normativa y la práctica de los derechos humanos a escala internacional es el proyecto de vida, el cual ha cobrado interés y suscitado discusión no solo debido a su carácter de derecho en construcción, sino por las dificultades que plantea su reparación integral, una vez se admite un “daño al proyecto de vida”. Es una investigación documental en la que se analiza el daño al proyecto de vida dentro de la jurisprudencia en el marco del Sistema Interamericano, específicamente en la Corte Interamericana de Derechos humanos (Corte IDH), donde se ha abordado como un derecho en construcción. A partir de esa perspectiva el concepto de daño al proyecto de vida es analizado en el contexto de Justicia Transicional que vive Colombia a fin de demostrar su importancia y necesaria integración al marco normativo del país para que estas afectaciones sean reconocidas y reparadas especialmente en las comunidades indígenas que han visto su plan de vida transgredido a causa del conflicto armado interno. Se demuestra que, reconocer el daño causado al proyecto de vida permitirá dignificar a la víctima, otorgándole la posibilidad de retomar su vida como lo hacía antes de los abusos sufridos.
Abstract
One of the most innovative concepts in the discourse, normative and practice of human rights on an international scale is the life project, which has gained interest and aroused discussion not only due to its nature as a right under construction, but also due to the difficulties posed by its comprehensive reparation, once a "damage to the life project" is admitted. It is a documentary investigation in which the damage to the life project is analyzed within the jurisprudence within the framework of the Inter-American System, specifically in the Inter-American Court of Human Rights, where it has been addressed as a right under construction. From this perspective, the concept of damage to the life project is analyzed in the context of Transitional Justice that Colombia lives in order to demonstrate its importance and necessary integration into the country's regulatory framework so that these affectations are recognized and repaired, especially in indigenous communities that have seen their way of life violated due to the internal armed conflict. It is shown that recognizing the damage caused to the life project will allow victims to be dignified, giving them the possibility of resuming their lifes as they did before the abuse suffered.
