El secreto profesional en el ámbito de las investigaciones administrativas por prácticas restrictivas de la competencia

El objetivo de este documento es analizar las razones por las cuales la Superintendencia de Industria y Comercio puede vulnerar el secreto profesional en una visita administrativa, y los riesgos que esto supone para el investigado y la autoridad. Este es un tema que resulta relevante al ser las visitas sorpresivas una herramienta fundamental para recolectar pruebas, además de no ser un tema pacífico alrededor del mundo (incluyendo Colombia, en donde no ha habido profundización al respecto). Nuestra conclusión principal, después de una revisión de normas y doctrina, es que este procedimiento requiere una regulación más garantista.

Abstract

The purpose of this document is to analyze the reasons why the Superintendence of Industry and Commerce may violate the professional privilege during a dawn raid, and the risks of this situation for the investigated party and the authority. This is a relevant topic because dawn raids are a fundamental tool to recollect evidence. Additionally, this is not a pacific topic around the world (including Colombia, where there has not been a lot of research). Our principal conclusion, after the review of laws and doctrine, is that this procedure requires a more protective regulation.
