Shipwrecked species and antiquities in the Colombian legal regime- The case of the Galeón San Josérésumé
Las especies y antigüedades náufragas son una clase de bienes que han sido objeto de múltiples modificaciones legislativas a lo largo de las últimas décadas, pues se han visto obligadas a adaptarse al desarrollo de nuevas actividades como los son la exploración, el hallazgo y el rescate de naufragios. Recientemente, debido a los avances tecnológicos y científicos, se han podido extraer en diferentes océanos del mundo ciertos navíos los cuales contenían objetos preciosos que, ante el juicio de expertos en la materia, eran considerados tesoros de alto valor económico. Sin embargo, paralelamente los Estados que consideran tener relación alguna con el hallazgo empiezan a intentar acreditar su legitimación para poder apropiarse del mismo junto con todas sus riquezas. Pues bien, alrededor del caso del Galeón San José se interpusieron intereses de diferentes Naciones, así como también de compañías caza-tesoros que reclamaban tener propiedad sobre dicho galeón. A pesar de un sin número de reclamaciones por parte de varios países, de enfrentarse en distintos tribunales y jurisdicciones a empresas privadas, Colombia culminó victoriosa ante todas aquellas controversias, por lo cual ha declarado que el pecio del Galeón San José le pertenece en su totalidad por integrar el patrimonio cultural sumergido de la Nación. Actualmente, los bienes del Galeón San José se encuentran blindados jurídicamente, al considerarse éstos inembargables, imprescriptibles e inalienables, y en ese sentido, no podrán estar bajo el dominio de privados ni de otros Estados.
Abstrait
Shipwrecked species and antiques are a type of goods that have been subject of multiple legislative modifications over the last decades, as they have been forced to adapt to the development of new activities such as exploration, discovery and rescue of shipwrecks. Recently, due to technological and scientific advances, it has been possible to extract in different oceans of the world certain ships which contained precious objects that, in the opinion of experts in the field, were considered treasures of high economic value. However, at the same time, Nations that consider to have a relationship with the finding begin to try to prove their egitimacy in order to appropriate it and all its wealth. Around the case of the Galeón San José , interests from different Nations intervened, as well as from treasure hunting companies that claimed to have property over the ship. In spite of a number of claims by various countries, of confronting private companies in different courts and jurisdictions, Colombia ended up victorious against all those controversies, which is why it has declared that the wreck of the San José belongs to Colombia because it is part of the submerged cultural heritage of the Nation. Currently, the assets of the Galeón San José are legally protected, as they are considered unseizable, imprescriptible and inalienable, and in this sense, they can not be under the control of private individuals or other States.
