El análisis jurisprudencial se centró en estudiar tres fallos de tutela
en sede de revisión, sobre asuntos que, tratándose de temas contractuales, se ventilan por
medio del mecanismo de tutela. Así mismo, como se puede ver en el documento, gran parte de las consideraciones
de las Altas Cortes, son tomadas de fallos proferidas por dichas entidades, las cuales se han
encargado de suplir ciertos vacíos que contiene la ley, o de adicionar requisitos no incluidos
en la ley.
Abstract
The jurisprudential analysis focused on studying three decisions of guardianship
at the review headquarters, on matters that, in the case of contractual matters, are aired by
means of the guardianship mechanism. Likewise, as can be seen in the document, a large part of the considerations
of the High Courts, are taken from rulings issued by entities, which have been
in charge of filling certain gaps contained in the law, or of adding requirements not included by law
