El retiro del pliego de peticiones : una omisión legislativa por corregir para evitar abusos del derecho

The withdrawal of the petition sheet : a legislative omission to be corrected to avoid abuses of the rightResumen
Tradicionalmente, los conflictos colectivos terminaban con la suscripción de una Convención Colectiva, escenario de acuerdo total, o con un laudo arbitral, cuando no hay un acuerdo y se constituye un Tribunal de Arbitramento. Sin embargo, recientemente, los sindicatos han optado por retirar el pliego de peticiones antes de que se suscriba la Convención o el Laudo quede en firme, para terminar el conflicto colectivo.
Nuestra legislación omite señalar si los sindicatos pueden retirar el pliego y, por ende, la validez y los efectos de esta conducta. ¿Existe una omisión legislativa respecto del retiro del pliego de peticiones? De ser afirmativa la respuesta, ¿es la omisión legislativa absoluta o relativa?
A pesar de que no se ha dado respuesta desde la academia ni desde la jurisprudencia a estas preguntas, el Ministerio del Trabajo y nuestras Altas Cortes han interpretado que esta conducta es válida y su efecto es terminar el conflicto colectivo. La tesis de las Cortes es que: (i) como esa conducta no está prohibida en la legislación, está permitida; y que (ii) el derecho a negociar de los sindicatos implica discrecionalidad y, por ello, debe subsistir la posibilidad de revocar las propuestas presentadas en el pliego de peticiones.
En la práctica, esto ha permitido que los sindicatos presenten un pliego de peticiones, se surtan ciertas etapas y luego retiren el pliego de peticiones, eliminando todo lo avanzado y habiendo estado ellos protegidos contra el despido por fuero circunstancial, presenten otro pliego, incluso con exactamente los mismos artículos; se tramiten las etapas de ley y puedan retirarlo nuevamente habiendo gozado de nuevo del fuero circunstancial; y así sucesivamente. La falta de pronunciamiento sobre los límites al retiro del pliego de peticiones ha permitido que los sindicatos sostengan diferentes conflictos colectivos sobre los mismos puntos y, por ende, que se prolongue el fuero circunstancial entre uno y otro conflicto colectivo sin que se llegue a una Convención o Laudo que termine el conflicto colectivo y genere estabilidad y certidumbre durante un periodo determinado.
Por lo anterior, vale la pena cuestionarse si presentar un pliego, retirarlo y volverlo a presentar preservando el fuero circunstancial, constituye un abuso al derecho de negociación. ¿Qué tan legítimo es presentar un pliego, retirarlo, volverlo a presentar, retirarlo y así sucesivamente? ¿Es realmente una estrategia de negociación o una forma de prolongar el fuero circunstancial y desgastar al empleador? ¿Estamos ante una nueva forma de carrusel?
Abstract
Traditionally, collective conflicts terminated with the subscription of a Collective Bargaining Agreement (total agreement scenario) or with an Arbitral Award (when there is no agreement and an Arbitral Court is incorporated). However, recently, unions have opted to withdraw the petition sheet before the Collective Bargaining Agreement is entered into or the Arbitral Award is in force, to terminate the collective conflict.
Our legislation does not establish if unions can withdraw the petition sheet and, therefore, the validity and effects of such conduct. Is there a legislative omission on the withdraw the petition sheet? If the answer is affirmative, is the omission absolute or relative?
Even though these questions have not been answered from the academy or court ruling, the Ministry of Work and our Courts have interpreted that this conduct is valid and that its effect is to terminate the collective conflict. The Court’s thesis is that: (i) as this conduct is not forbidden in our legislation, it is allowed; and that (ii) the negotiation right of unions implies discretion and therefore, the possibility of revoking the proposals submitted in the petition sheet, must remain.
In practice, this has allowed unions to file a petition sheet, certain stages take place and then unions withdraw the petition sheet, eliminating all progress and having been protected against dismissal by circumstantial protection; and then, again, they can file another petition sheet (even with the exact the same articles), the stages of the law take place and they can withdraw it again having enjoyed circumstantial protection again; and so on. The lack of pronouncement on the limits to the withdrawal of the petition sheet has allowed unions to maintain different collective conflicts on the same points and, therefore, the prolongation of the circumstantial protection between one and other collective conflict without reaching a Collective Bargaining Agreement or an Arbitral Award that terminates the collective conflict and generates stability and certainty during a specific period.
Therefore, it is worth asking whether submitting a petition sheet, withdrawing it and presenting it again, preserving the circumstantial protection, constitutes an abuse of the negotiation right. How legitimate is to file a petition sheet, withdraw it, submitting it again, withdraw it and so on? Is it really a negotiation strategy or a way to prolong the circumstantial protection and wear down the employer? Are we facing a new form of carousel?
