El derecho de autor cuenta con una dicotomía entre: la protección de aquella obra realizada por un autor que tiene derecho a su protección y por otro lado el carácter y función que tienen dentro de la sociedad para difundir conocimiento en áreas como el arte, el entretenimiento y la divulgación científica. Si bien los derechos no son perpetuos y existe la figura del dominio público, dentro de la vida protegida de la obra se encuentran las limitaciones y excepciones, que son aquellas que permiten bajo ciertas situaciones usar una obra sin necesidad de pagar o ser autorizados para ello.
Actualmente, estas limitaciones y excepciones constituyen un pilar importante para la divulgación de contenido, y más en la época actual donde la información viaja con mayor rapidez debido a las herramientas digitales. Es por esto, que el presente trabajo busca hacer un recorrido en la normativa de los Estados Unidos, la Unión Europea y la CAN, con el fin de establecer cómo estos sistemas acogen el sistema de limitaciones y excepciones de los derechos de autor y cómo estos operan en el entorno digital. Específicamente, se busca hablar del algoritmo Content ID de YouTube, el cual se utiliza para encontrar posibles infracciones del contenido subido a la plataforma, y si este es capaz de clasificar contenidos que se encuentran amparados por las limitaciones y excepciones que contempla el fair use.
Abstract
Copyright has a dichotomy between the protection of the work made by an author who is entitled to its protection, and the diffusion of knowledge, innovation, entertainment and scientific dissemination. Although the rights are not perpetual and the figure of the public domain exists, within the protected life of the work we can find the limitations and exceptions; which are those that allow under certain circumstances to use a work without having to pay for it. Currently, these limitations and exceptions are an important pillar for the dissemination of content, and more so in the current era where information travels faster due to digital media tools. For this reason, this work seeks to take a look at the regulations in the United States, the European Union and the Andean Community, in order to establish how these systems embrace the system of limitations and exceptions to copyright and how they operate in the digital environment. Specifically, it seeks to discuss YouTube’s algorithm, Content ID, that is used to identify potential infractions to the copyright in the content uploaded by the user and its ability to classify the content as protected by the fair use.
