Does the primary constituent power have legal limits? A question about the basis for the validity of LawResumen
La Corte Constitucional de Colombia, así como gran parte de la doctrina, han sostenido que el poder constituyente primario no tiene límites jurídicos, toda vez que de él surge el Derecho. Por eso, para esta postura, cualquier determinación que adopte el poder constituyente primario es Derecho; incluso si aquella consiste en privar de derechos a ciertas personas. Pero ¿es acertada esta posición?; considero que no. Por ello, este trabajo pretende mostrar por qué el poder constituyente primario es un poder que surge del Derecho y, por ende, señalar cuáles son los límites jurídicos a los que está sujeto.
Abstract
The Constitutional Court of Colombia, as well as a large part of the doctrine, has held that the primary constituent power has no legal limits since Law arises from it. Therefore, for this position, any determination adopted by the primary constituent power is Law, even if it consists of depriving certain persons of their rights. But is this position correct; I do not think so. Therefore, this paper intends to show why the primary constituent power is a power that arises from Law and, therefore, to point out which are the legal limits to which it is subject.
