La regularización migratoria de los migrantes forzados venezolanos ha sido uno de los mayores desafíos para la región en el contexto de la crisis y el éxodo venezolano, sobre todo para Colombia, Perú y Ecuador, como los mayores receptores de migrantes. Esta supone la puerta de acceso a los derechos fundamentales, ya que liga a la persona a la jurisdicción del Estado. La institución creada para la protección de los Derechos Humanos (DDHH) en la región, es decir, el Sistema Interamericano de Derechos Humanos (SIDH), debe propender por las garantías en el acceso a dichos derechos, donde el estatus regular es fundamental. Bajo el supuesto de que las reglas y las instituciones son de gran relevancia, como expone el marco teórico de la Escuela Inglesa, realizar una observación del actuar de la institución creada para proteger los DDHH es clave, desde las diferentes posturas que aporta la teoría. El presente texto busca examinar el papel y la actuación del SIDH frente a la problemática de la migración forzada venezolana, en la búsqueda de la regularización migratoria. Para ello, se realiza una revisión documental y de prensa en torno a las medidas de regularización migratoria implementadas en Colombia, Perú y Ecuador y los pronunciamientos y acciones del SIDH, utilizando los postulados de la Escuela Inglesa como categorías de análisis fundamentales en la investigación, y examinando las competencias y procedimientos de los órganos rectores en la protección de los derechos: la Comisión y la Corte Interamericana de Derechos Humanos.
Astratto
The migration regularization of venezuelan forced migrants has been one of the greatest challenges for the region in the context of the Venezuelan crisis and exodus, especially for Colombia, Peru and Ecuador, as the largest recipients of migrants. This is the gateway to fundamental rights, since it links the person to the jurisdiction of the State. The institution created for the protection of Human Rights (HR) in the region, that is, the Inter-American Human Rights System (IHRS), must strive for guarantees in access to these rights, where regular status is essential. Under the assumption that the rules and institutions are of great relevance, as the theoretical framework of the English School exposes, making an observation of the actions of the institution created to protect human rights is key, from the different positions provided by the theory. This text seeks to examine the role and performance of the IHRS in the face of the problem of Venezuelan forced migration, in the search for migratory regularization. For this, a documentary and press review is carried out on the immigration regularization measures implemented in Colombia, Peru and Ecuador and the pronouncements and actions of the IHRS, using the postulates of the English School as fundamental analysis categories in the investigation, and examining the powers and procedures of the governing bodies in the protection of rights: the Commission and the Inter-American Court of Human Rights.
