Retos y oportunidades en la negociación colectiva en el sector público

Este trabajo de maestría abordó el estudio de la negociación colectiva en el sector público en Colombia desde el punto de vista teórico y práctico. Desde el punto de vista teórico se realizó un estudio de la evolución del derecho a la negociación colectiva en el país, profundizando en el Decreto 160 de 2014, y además se realizó un análisis de derecho comparado en Latinoamérica. Por su parte, la investigación práctica implicó el estudio de los acuerdos colectivos suscritos en el país en los años 2019 y 2020. Una vez procesado el estudio antes mencionado en su integridad se establece el alcance actual de los acuerdos colectivos que se han suscrito en el país, la necesidad o no de una reforma al Decreto 160 de 2014, así como los aspectos relevantes que una eventual reforma legal en la materia debe incluir.

Abstract

This work addressed the study of collective bargaining in the public sector in Colombia from a theoretical and practical point of view. From a theoretical perspective, the investigation approaches the evolution of the right to collective bargaining in the country, delving deeper into Decree 160 of 2014. Moreover, the author did a study of comparative law in Latin America about the mentioned right. The practical study consists of an analysis of the Colombian collective agreements signed in 2019 and 2020. This investigation allows understanding the current scope of the collective agreements signed in the country, the need or not of legal reform to Decree 160 of 2014, and the relevant aspects that an eventual legal reform should include.
