La justicia restaurativa en el marco de justicia y paz

Este trabajo de investigación pretende hacer una revisión sobre la Justicia Restaurativa a través del marco legal y las sentencias proferidas dentro del proceso de Justicia y Paz. Se hace un recuento sobre el paramilitarismo en Colombia, sus causas, características y modus operandi, posteriormente se presentan las bases conceptuales de la Justicia Transicional y Restaurativa, para luego exponer el marco legal de Justicia y Paz. Finalmente se muestran aspectos considerados como restaurativos encontrados en las sentencias y medidas de reparación decretadas para concluir que la Justicia Restaurativa sí se encuentra presente en los procesos de Justicia y Paz.

Abstract

This dissertation´s purpose is reviewing Restorative Justice through Justice and Peace´s [process] legal framework and court rulings. First off, it summarizes the main aspects and events that lead to the paramilitarism phenomenon in Colombia. Afterwards the conceptual foundations of Restorative and Transitional justice are laid out, to explain the legal framework to the Justice and Peace process. Lastly aspects considered as restorative are shown in the judicial judgments and reparation instruments ordered , in the interest to conclude that Restorative Justice can, in fact, be seen throughout the Justice and Peace processes
