The periodic, present and future humanitarian provision of special protection to the victims of the armed conflict in Colombia. ¿Is it possible to improve?Resumen
Esta investigación descriptiva documental estudia a profundidad las principales problemáticas relacionadas con la estructuración y consecuencias de la aplicación de la Prestación humanitaria periódica en Colombia, figura jurídica creada como reglamentación de la Pensión mínima especial para víctimas del conflicto armado.
Mediante una revisión de la normatividad, jurisprudencia, documentos oficiales tanto nacionales, como internacionales, de literatura científica y gris, se encontró que en Colombia existe una pensión especial soportada en la normatividad vigente con la Ley 418 de 1997 y el Decreto 600 de 2017, que resultan contrarias a los principios de no regresividad e igualdad en la protección social constitucional y no propugnan por una verdadera rehabilitación integral de este grupo poblacional, siendo barrera administrativa de acceso al mundo laboral para efectuar aportes al Sistema Integral de Seguridad Social.
Por lo anterior, en el artículo se proponen tres alternativas de mejora al interior de la normatividad nacional como son: la rehabilitación integral de la víctima y su familia, la sustitución pensional o una renta básica focalizada.
Abstract
This descriptive documentary research studies in depth the main problems of the structuring and consequences of the application of the Periodic Humanitarian Benefit, a legal figure created as a regulation of the special minimum pension for victims of the armed conflict, and proposes alternatives to improve it, considering aspects of protection of the acquired right and substitution of the benefit to a minimum income.
Through a review of regulations, jurisprudence, official documents both national and international, scientific and gray literature, it was found that in Colombia there is a special pension supported by Article 46 of Law 418 of 1997 with the limitations and prohibitions contained in Decree 600 of 2017, which is contrary to the principles of non-regressivity and equality in constitutional social protection and does not advocate for a true comprehensive rehabilitation of this population group, being administrative barrier of access to the labor world to make contributions to the comprehensive Social Security System.
Three alternatives for improvement within the national regulations are proposed, such as: comprehensive rehabilitation of the victim and his family, pension substitution or a targeted basic income.
