With the legal considerations provided by decision SL-1680 of 2020 of the Supreme Court of Justice, was created a qualifying event for partial strike in essential services?Resumen
En el presente trabajo, se abordará el concepto de huelga, las diferentes clases que existen en Colombia y el concepto de servicio público esencial como límite a su ejercicio, en el marco de algunas sentencias de la Sala Laboral de la Corte Suprema de Justicia.
Acto seguido, se realiza un análisis de la sentencia SL 1680 de 2020, proferida por la Sala Laboral de la Corte Suprema de Justicia, para determinar si esta creó un nuevo criterio para darle viabilidad a la ejecución de huelgas parciales en empresas que prestan servicios públicos esenciales.
Para agotar este interrogante, se tuvo como parámetros de referencia los pronunciamientos emitidos por la Organización Internacional del Trabajo, el Marco Legal Colombiano, y algunas sentencias emitidas por la Corte Constitucional y la Sala Laboral de la Corte Suprema de Justicia.
El resultado indicará que, en efecto la sentencia SL 1680 de 2020, tomó parámetros nuevos para el análisis de la legalidad de las huelgas, creando reglas de juego que podrían dar luz verde a ejecutar huelgas parciales en empresas que prestan servicios públicos esenciales, como el de la salud.
Abstract
In the present work, the concept of strike, the different classes that exist in Colombia and the concept of essential public service as a limit to its exercise will be addressed, within the framework of some sentences of the Labor Chamber of the Supreme Court of Justice.
Immediately afterwards, an analysis of the judgment SL 1680 of 2020, issued by the Labor Chamber of the Supreme Court of Justice, is carried out to determine if it created a new criterion to make it viable to carry out partial strikes in companies that provide public services. essential.
To exhaust this question, the reference parameters were the pronouncements issued by the International Labor Organization, the Colombian Legal Framework, and some sentences issued by the Constitutional Court and the Labor Chamber of the Supreme Court of Justice.
The result will indicate that, in effect, ruling SL 1680 of 2020, took new parameters for the analysis of the legality of strikes, creating rules of the game that could give the green light to carry out partial strikes in companies that provide essential public services, such as the Of the health
