Resumen

El sistema presidencial surgido en Colombia, con la Constitución de 1821, es el resultado de un proceso histórico que comenzó dando respuesta a la pregunta ¿Quién gobernaría ante la ausencia del Rey?. Por ende, luego de las experiencias provenientes de las Constituciones Provinciales (1811-1815) y posterior a la reconquista española; las directrices militares y el acento jerárquico de Simón Bolívar, marcaron los parámetros para establecer un poder presidencial fuerte, eficaz, central y dotado de inmensas facultades ordinarias y extraordinarias, las cuales fueron incorporadas en la primera Constitución de Colombia. Esta perceptible y lenta construcción del régimen presidencial es el resultado del ejercicio del primer presidente de la República, encarnado en un militar sobresaliente y dotado de inmensas potestades constitucionales expresas y muchas de las veces implícitas.

Abstract

The presidential system that emerged in Colombia, with the Constitution of 1821, is the result of a historical process that began by answering the question: Who would govern in the absence of the King? Therefore, after the experiences from the Provincial Constitutions (1811-1815) and after the Spanish reconquest; the military directives and the hierarchical accent of Simón Bolívar set the parameters to establish a strong, effective, central presidential power endowed with immense ordinary and extraordinary powers, which were incorporated into the first Constitution of Colombia. This perceptible and slow construction of the presidential regime is the result of the exercise of the first president of the Republic, embodied in an outstanding military man endowed with immense express and often implicit constitutional powers.
