La regulación actual de la responsabilidad penal de las personas jurídicas en Colombia presenta problemas evidentes, entre ellos la falta de claridad sobre su existencia teniendo en cuenta la normativa de la ley 906 de 2004 y las medidas que puede tomar el juez penal en contra de las mencionadas personas jurídicas además de presentar evidentes riesgos para la sociedad y el interés general si se aplicasen dichas medidas ante empresas sistémicamente importantes. Colombia debe solucionar las fallas dentro de su normativa tomando como ejemplo múltiples ordenamientos jurídicos del mundo, y así lograr una mayor eficiencia frente a este problema.
Abstract
The current regulation of the criminal liability of legal entities in Colombia presents evident problems, among them the lack of clarity about its existence taking into account the regulations of the law 906 of 2004 and the measures that the criminal judge can take against the mentioned legal persons in addition to presenting evident risks for society and the general interest if such measures were to be applied to systemically important companies. Colombia must solve the flaws within its regulations, taking as an example multiple legal systems in the world, and thus achieve greater efficiency in the face of this problem.
