Retos y aplicaciones de la tecnología blockchain en el contexto jurídico actual

El avance que ha tenido la tecnología blockchain en la última década ha permitido el desarrollo de un sin números de proyectos y ecosistemas capaces de impactar de un modo significativo la forma en como los seres humanos se relacionan, así, ha permitido la transformación de activos físicos a digitales, ha impactado en las tracciones internacionales moviendo activos a través de los Smart Contracts, ha contribuido al desarrollo de nuevas formas de financiación empresarial, entre otras. Estas nuevas dinámicas han propiciado un interés, cada vez más creciente, de la ciencia jurídica por comprender estos fenómenos, en aras de evitar malas prácticas por los agentes y de impulsar los beneficios que trae consigo este tipo de tecnología

Abstract

The advancement that blockchain technology has experienced in the last decade has enabled the development of countless projects and ecosystems capable of significantly impacting the way humans relate to each other. It has facilitated the transformation of physical assets into digital ones, influenced international transactions by moving assets through Smart Contracts, and contributed to the development of new forms of business financing, among other things. These new dynamics have spurred a growing interest from legal science in understanding these phenomena, aiming to prevent misconduct by agents and to drive the benefits that this type of technology brings with it
