How applying a compliance program impacts the development of startupsResumen
El compliance es una herramienta que fomenta la protección y cumplimiento del ordenamiento jurídico y la ética empresarial. Es una figura acogida tanto a nivel internacional como a nivel nacional, dada la complejidad del mercado actual y el aumento de los riesgos que este implica, imponiendo a las empresas la necesidad de adoptar un programa que les permita prevenir riesgos y estar dentro del marco de lo legal y la buena práctica empresarial. El mismo crecimiento y dinamismo del mercado dio origen a nuevos esquemas empresariales como las startups, las cuales no son ajenas a dichos programas de cumplimiento. En el presente artículo, se realiza un estudio detallado de la figura del compliance, las startups y el impacto, tanto positivo como negativo de su implementación.
Abstract
Compliance is a legal tool that promotes the protection and observance of the legal system and business ethics. It is a figure accepted at international and national scopes given the complexity of the current market and its increased risks, imposing companies the need to adopt a program that allows them to prevent risks and be within the framework of the legal and good business practice. The same growth and dynamism of the market gave rise to new business schemes such as startups, which are not impassive to the referred programs. This article develops a detailed study on the figure of compliance, startups and the impact, both positive and negative, of its implementation.
