ELECTORAL THRESHOLD AND POLITICAL PLURALISM: AN ANALYSIS FROM THE PERSPECTIVE OF THE SITUATION LIVED BY THE POLITICAL PARTY NUEVO LIBERALISMOResumen
Este artículo es el resultado de una investigación que tuvo como objetivo realizar un análisis crítico de la sentencia de la Corte
Constitucional respecto al Partido Nuevo Liberalismo. Entre los argumentos utilizados por la Corte se destaca una antinomia entre el derecho a fundar partidos y movimientos políticos y el umbral electoral consagrado en la Constitución. También, plantea la imposibilidad que tuvieron los militantes del Partido de continuar su vida política. Este escrito busca determinar si en efecto existe tal antinomia, verificar la imposibilidad planteada por la Corte para los militantes del Nuevo Liberalismo y brevemente nombrar algunas consecuencias que tiene este fallo en el funcionamiento del derecho electoral. La investigación nos llevó a apartarnos de la decisión adoptada debido a que estamos en desacuerdo con los argumentos en que fundamentó su fallo. Lo anterior por motivos que elaboraremos en el artículo.
Abstract
"This article is the result of a research project that aimed to carry out a critical analysis of the Constitutional Court ruling regarding the Nuevo Liberalismo Political Party. Among the arguments used by the Court, it stands out an antinomy between the right to constitute political parties and movements, and the electoral threshold required by the Constitution. Also, those challenges that the members of Nuevo Liberalismo faced which made it impossible for them to continue with their political aspirations. This article seeks to determine if such antinomy exists, verify the impossibility the Court argues members of the Nuevo Liberalismo faced to continue their political aspirations, and briefly explain the consequences that the ruling brought to electoral law. As a result of the investigation, we decided to draw away from the ruling uttered by the Court due to our disagreement on the arguments used to build up their decision.This for reasons we will elaborate in this article.
