THE NEED OF GREATER INTERNATIONAL COOPERATION FOR PROTECTION OF INDIGENOUS PEOPLES CULTURAL HERITAGE AND TRADITIONAL KNOWLEDGEResumen
Este artículo analiza la urgente necesidad de intensificar la cooperación internacional para proteger el patrimonio cultural y el conocimiento tradicional de los pueblos indígenas, cuyos derechos han sido históricamente vulnerados. Ante el crecimiento del comercio global, las redes sociales y las corporaciones transnacionales, el problema de la apropiación cultural sigue afectando gravemente a estas comunidades. A pesar de los esfuerzos internacionales, como la Declaración de Derechos de los Pueblos Indígenas de la ONU y diversas convenciones, los resultados han sido insuficientes debido a problemas de cumplimiento y recursos. Este artículo propone un marco de cooperación internacional mediante la Propiedad Intelectual, adaptado para incluir activamente a las comunidades indígenas en la toma de decisiones, con el objetivo de proteger y preservar sus derechos culturales y conocimientos.
Abstract
This article addresses the urgent need for enhanced international cooperation to protect the cultural heritage and traditional knowledge of Indigenous peoples, whose rights have been historically compromised. With the growth of global commerce, social media, and transnational corporations, cultural appropriation continues to significantly impact these communities. Despite international efforts like the UN Declaration on the Rights of Indigenous Peoples and various conventions, outcomes have been limited by compliance and resource challenges. This article proposes a framework of international cooperation through Intellectual Property, designed to actively include Indigenous communities in decision-making processes, aiming to
protect and preserve their cultural rights and knowledge.
