COPYRIGHT IN THE AGE OF ARTIFICIAL INTELLIGENCEResumen
El derecho siempre debe encontrarse en constante evolución, respondiendo a los cambios y transformaciones en momentos determinados. Con el auge de la tecnología, los países se enfrentan a un nuevo desafío para enfrentar el crecimiento de la inteligencia artificial y sus efectos en los derechos de autor, para así determinar a quién le podrían pertenecer creaciones artísticas en la era del aprendizaje automatizado. El presente artículo de investigación busca determinar a quién corresponde la autoría de las obras protegidas por el derecho de autor si éstas son generadas por una herramienta de inteligencia artificial. Dicha determinación se hará mediante la investigación cualitativa del régimen legal existente en Colombia y las diferentes soluciones propuestas por otros países.
Abstract
Law must always be in constant evolution, responding to changes and transformations at specific times. With the rise of technology, countries are facing new challenges, where they must confront the growth of artificial intelligence and its effects on copyright in order to determine who has ownership over creations in the era of automatized learning. This research article seeks to determine who holds the authorship of works protected by copyright when an artificial intelligence tool generates them. This determination will be made through qualitative research of the existing legal framework in Colombia and the different solutions proposed by other countries.
