En la sentencia C-252 de 2019, la Corte Constitucional cambió su jurisprudencia sobre cómo ejerce el control de constitucionalidad de los acuerdos internacionales de inversión. Por 20 años, la Corte había ejercido pacíficamente el control de los acuerdos internacionales de inversión con un alto grado de deferencia hacia la Rama Ejecutiva. Pero al analizar la constitucionalidad del acuerdo suscrito entre Colombia y Francia, la Corte declaró su exequibilidad condicionada y por primera vez, interpretó el acuerdo a partir de la ‘jurisprudencia arbitral’. Este texto sostiene que dicho control no se enmarca en las funciones constitucionales de la Corte.
Abstract
In decision C-252 of 2019, the Constitutional Court changed its jurisprudence on how it exercises constitutional control over international investment agreements. For 20 years, the Court had peacefully exercised control over international investment agreements with a high degree of deference towards the executive branch. However, when analyzing the constitutionality of the agreement signed between Colombia and France, the Court declared its conditional enforceability and, for the first time, interpreted the agreement based on 'arbitral jurisprudence.' This text argues that such control does not fall within the constitutional functions of the Court
