| dc.description.abstract | En el siguiente artículo se expondrán brevemente los postulados doctrinarios y jurídicos a partir de los cuales es viable la responsabilidad penal de las personas jurídicas en nuestro ordenamiento, más allá de las sanciones administrativas que actualmente se aplican y que han resultado ser ineficientes. Al igual, se estudiará teóricamente la imputación de conductas delictivas a este tipo de personas a partir de la necesidad político- criminal bajo los principios de la justicia restaurativa. Este texto de investigación a su vez, propondrá la pena privativa de la autonomía empresarial como una sanción para que el Estado garantice la efectiva reparación a las víctimas, sea económico-eficiente y prevenga la conducta punible. | spa |
| dc.description.abstractenglish | In the following article there will be exposed briefly the doctrinaire and juridical postulates from which the penal responsibility of the legal persons is viable in our legal system, beyond the administrative sanctions that nowadays are applied and that have turned out to be inefficient. With this purpose there will be studied theoretically the imputation of criminal conducts to this type of persons from the perspective of the political-criminal need under the values of the restorative justice. This text of investigation will propose the privative penalty of the managerial autonomy as a sanction in order that the State guarantees the effective repair to the victims, to be economic - efficient and prevent the punishable conduct. | spa |
