| dc.description.abstract | El presente documento es producto de una investigación realizada en el marco de la asignatura de pregrado de Controversias Constitucionales de la Pontificia Universidad Javeriana. Al reconocer la importancia de la participación en política de los actores del conflicto el contexto transicional generado a partir del Acuerdo de Paz del Teatro Colón y los límites normativos que ello encuentra en el ordenamiento jurídico colombiano, se identifican dos criterios que hacen viable dicha participación: el cumplimiento del deber estatal de investigar, juzgar y sancionar los graves crímenes y la satisfacción de los derechos de las víctimas. Finalmente se analiza lo dispuesto en el mencionado Acuerdo para concluir que no cumple a cabalidad con los presupuestos señaladas entorno a la participación política en el posconflicto. | spa |
| dc.description.abstractenglish | This paper is the product of the research regarding the study of Constitutional Controversies in the undergraduate Law Studies course at Javeriana University Law School. . Recognizing the importance of the participation in politics of conflict's participant under the transitional context generated from the Peace Agreement of the Colon Theater and the normative limits that this finds in the Colombian legal system, two criteria are identified that make achievable such participation: The fulfillment of the State's duty to investigate, prosecute and punish serious crimes and the satisfaction of victims' rights. Finally, the provisions of the aforementioned Agreement are analyzed to conclude that it does not fully comply with the budgets indicated regarding political participation in post-conflict. | spa |
