dc.description.abstractEn el año 2006 se expidió en Colombia un nuevo régimen de insolvencia empresarial, el cual sólo entró a regir hacia mediados del año 2007. El mismo pretende recoger las experiencias y errores de los regímenes anteriores, para crear una normativa con vocación de permanencia. El autor nos presenta su visión sobre cuáles son los requisitos mínimos de cualquier régimen de insolvencia, las modificaciones introducidas por este nuevo régimen colombiano y los vacíos e inconsistencias estructurales presentados en el mismo, gracias a su participación en la comisión redactora del anteproyecto de ley que le dio origen, todo como un producto de investigación dentro del marco del proyecto Interpretación y Aplicación del Derecho Privado del Grupo de Investigación en Derecho Civil y Comercial de laFacultad de Ciencias Jurídicas de la Pontificia Universidad Javeriana.spa
dc.description.abstractenglishIn 2006, Colombia promulgated a new law to regulate insolvency of colombian enterprises, which is in force since june 2007. This law takes all the experiencies and all the mistakes lived before to create a new regime that is planned to exist for a long period of time. The author gives us, due to his participation in the commission created to draft the law, his opinion about the minimal conditions any insolvency law must have, the main modifications made by the new colombian insolvency regime and the structural voids and inconsistencies of this law. This is an investigation product of the Interpretation and application of Private Law project, which is one of the projects of the Civil and Commercial Law Investigation Group of the Faculty of Law in Pontificia Universidad Javeriana.eng
