| dc.description.abstract | Las personas han pactado, cada una con cada una, en abandonar parte de su libertad natural y cederla al Estado, para que este sea quien gobierne sobre ellos en miras del bien común. Al menos eso es lo que afirma la teoría del contrato social, según la cual la legitimidad de un Estado deriva del consentimiento de sus ciudadanos. Para la doctrina, ese consentimiento puede ser expreso, implícito o hipotético. Sin embargo, ninguno de estos tipos de consentimiento es viable para legitimar al Estado, bien sea porque teóricamente no constituyen en un consentimiento real o bien porque, en la práctica, justifican las democracias iliberales. De esa manera, el contrato social es un mito, una ficción del derecho. Por ende, se propone que la verdadera fuente de legitimidad del Estado es la utilidad que este tenga para velar por el bien común y los derechos de todas las personas. | spa |
| dc.description.abstractenglish | People have agreed, each one with each other, to abandon part of their natural freedom and cede it to the state, so that it may rule over them for the common good. At least this is what the theory of the social contract says, according to which a state's legitimacy derives from its citizens' consent. This consent, following the doctrine, can be express, implicit, or hypothetical. However, none of these types of consent is viable to legitimize the State, either because theoretically they do not constitute real consent, or because in practice they justify the illiberal democracies. In this way, the social contract is a myth, a fiction of law. Therefore, I propose that the true source of legitimacy of the State is the utility it provides to ensure the common good and the rights of all the people. | spa |
