Tecnologías disruptivas y derecho en Colombia : la nueva forma de ejercer la profesión

| dc.description.abstract | Este artículo estudia la relación que paulatinamente se ha creado entre derecho y tecnología, particularmente frente a las tecnologías disruptivas. Las profesiones han ido evolucionando a lo largo del tiempo, pero el ejercicio del derecho parece continuar haciéndose de la misma manera, la tesis del documento sugiere entonces que los cambios tecnológicos que han llegado al campo legal hacen necesariamente plantearse la pregunta ¿Cuál es el rol de los abogados en el Siglo XX1? Al inicio del documento se analiza la noción de disrupción en el ámbito tecnológico, quién acuñó el término y la relevancia contemporánea del mismo en los mercados—La confrontación entre Uber y los taxis o Airbnb y los hoteles son relevantes tanto para quienes compiten por los usuarios como para los abogados que se enfrentarán a procesos relacionados con los temas—. Luego de ello se estudia la lenta imbricación entre derecho y tecnología que se ha ido creando como consecuencia del vacío que entran a llenar las tecnologías disruptivas al proveer servicios a un menor costo y el posible impacto en la democratización del acceso a la asesoría jurídica. Luego estudia algunos ejemplos internacionales que ya evidencian la presencia de plataformas digitales prestando servicios legales. Por último, luego de señalar con ahínco la relación que ante nuestros ojos está naciendo, se procede a realizar algunas breves conclusiones más descriptivas y propositivas que resolutivas. | spa |
| dc.description.abstractenglish | This paper explores the relationship that gradually has been created between Law and technology, particularly with disruptive technologies. Professions have evolved over time, but the exercise of the legal occupation seems to continue in the same way; the thesis of the paper suggests that the technological changes that have arrived to the legal inevitably makes us ask: What’s the role of lawyers in the XX1 century? The beginning of the document discusses the notion of disruption in the technological field, who coined the term and the relevance in today’s markets—The confrontation between Uber and taxis or Airbnb and hotels debates are relevant both for those workers who compete for users but also to lawyers who will face lawsuits related to those topics—. Later, it examines the slow imbrication that’s been created between legal services and technology, how this has been the result of a market flawless that’s been filled up by disruptive technologies which provide services at a lower cost and the possible impact on the democratization of access to legal advice. Then, it studies international examples that already demonstrate the presence of digital platforms already providing legal services. Finally, after hard noted the relationship that is being born before our eyes, the paper provides some brief conclusions, more descriptive and purposeful rather than decisive ones. | spa |
