PRIVATE SECTOR RESPONSIBILITY IN HUMAN RIGHTS ISSUESrésumé
El presente artículo tiene por objeto revisar cuál es la situación actual de las empresas en el ámbito internacional, a la luz de los derechos humanos. En este sentido, aborda algunas iniciativas políticas y económicas importantes, como es el caso del Pacto Global y la responsabilidad social empresarial, dirigidas al involucramiento del sector privado en el quehacer público frente a la sociedad, y en especial frente a los derechos humanos, para posteriormente abordar el plano jurídico, enfocándose en una revisión del régimen de responsabilidad internacional por violaciones a los derechos humanos. Tras llevar a cabo la revisión, el principal hallazgo se refiere a la inexistencia de mecanismos claros que le permitan a las empresas ajustar sus actividades con estándares de respeto a los derechos humanos; igualmente, a la ausencia derecursos efectivos e idóneos que protejan a las víctimas de los abusos cometidos por las empresas o con su complicidad; y finalmente, sin que existan instancias competentes en el plano internacional, para conocer de este tipo de violaciones en las que las empresas están directamente involucradas y, por ende, son responsables de tales actos.
Abstrait
The main objective of this article is to revise the present situation of the enterprises in the light of the human rights issues at the international arena. According to this, it takes into account some political and economical initiatives, like Global Compact and corporate social responsibility, addressed to involve the private sector in public affairs related to society, especially with human rights. Subsequently it focuses on legal aspects, mainly in those that establish the principal aspects of the international responsibility in cases of human rightsviolations. After the examination of those initiatives and some legal aspects concerned with the international responsibility regime, the main findings were three. The first one referred to the absence of mechanisms that allows the corporations to fit their activities with human rights standards; the secondone related to the lack of effective and appropriate resources established to protect the victims against the abuses and violations of human rights, committed by the private sector; and finally, concerned to the non-existence of an international structure that can assume cases which involve the privatesector as direct responsible of that kind of acts.
